أسدلت محكمة جنايات القاهرة الستار على واحدة من أكبر قضايا الاتجار في الأعضاء البشرية هذا العام، والمتهم فيها طبيب بشري و٤ آخرين وأدانتهم المحكمة بأحكام رادعة، عن تهمة إدارة جماعة إجرامية منظمة غرضها الاتجار بالبشر والتي يتزعمها رئيس مجلس إدارة مستشفى تخصصي شهير بحي مصر الجديدة بمحافظة القاهرة.
وعاقبت المحكمة المتهم حسام.م، طبيب جراح و3 آخرين هم “محمد.أ” و”مصطفى.ع” و”صباح.م” بالسجن المشدد 10 سنوات، والسجن المشدد 6 سنوات للمتهمة سكرتيرة الطبيب وتدعى نادية، وغرامة 200 ألف جنيه للجميع، مع غلق المستشفى التخصصي الشهيرة والمملوكة للمتهم الأول لمدة عام.
وصدر الحكم في 22 ديسمبر الجاري برئاسة المستشار محمد أحمد الجندي، وعضوية المستشارين أيمن عبد الخالق ومحمد أحمد صبري.

استطاع طبيب بشري شهير، وهو أستاذ جراحة كلى، ورئيس مجلس إدارة مستشفى تخصصي معروف بمصر الجديدة في تأسيس منظمة إجرامية مكونة من 6 عناصر في مصر بعام 2010 تزعمها بمعاونة سكرتيرته “نادية” و”أبو اسكندر” صاحب الخبرة بين سماسرة الاتجار بأرواح البشر وبيع الأعضاء البشرية بالإسكندرية فكان حلقة الوصل بين الأطباء و”الكشافة” الذين يجوبون المناطق والأحياء الشعبية بحثا عن ضحاياهم من المستضعفين والمحتاجين والمكروبين.
وثبت بخطاب وارد من، انتربول القاهرة، أن الطبيب زعيم مافيا الأعضاء البشرية بالقاهرة له معلومات جنائية وسبق ضبطه وتسليمه تنفيذا لأمر قبض دولي صادر من السلطات القضائية الأردنية لاتهامه بالقيام بعمليات بيع الأعضاء البشرية واستقطاب ضحاياه من المصريين مستغلا حاجتهم للمال وهو ما يتضح معه أن المتهم الأول عضو في جماعة منظمة دولية تستهدف الاتجار في البشر.
كيف كانت تدار مافيا تجارة الأعضاء البشرية بالقاهرة؟
كشفت التحقيقات، عن آليات توزع الأدوار داخل المنظمة الإجرامية عن طريق تكليفات من زعيمها الجراح الشهير والذي يترأس الفريق الطبي مجري عمليات نقل واستئصال وزراعة (الكبد والكلى) وتعاونه سكرتيرة بالمستشفى التي يملكها ويترأسها المتهم الأول، وجاءت تفاصيلها في النقاط التالية:
أولا: يقوم «الكشافة» باستقطاب المجني عليهم من الأحياء الشعبية وإقناعهم باستئصال كلاهم وبيعها مقابل حصولهم على مبالغ ماليه مستغلين في ذلك حاجتهم إلى المال شريط توقيعهم على إيصالات أمانه ضمانا لعدم رجوعهم في إجراء العملية ونقل الكلى.
ثانيا: هناك آخرون مكلفون بتجهيز الضحايا لإجراء التحاليل الطبية اللازمة لإتمام العملية وإنهاء الإجراءات والأوراق المطلوبة بوزارة الصحة وهو دور كل من المتهمين الثالث والرابع والخامس”.
ثالثا: يتم تسليم الضحايا لمتهم أخر- توفي قبل بدأ المحاكمة- والذي كان يتولى الاتصال بالأطباء وإبلاغهم بنتائج التحاليل والأشعة التي أجريت وبدورهم يقوم الأطباء بالتوفيق بين حالات المتبرعين وحالات المرضي راغبي زرع الكلى.
وأوضحت التحريات أن عمليات زرع واستئصال الكلى أُجريت بـ 7 مستشفيات خاصة وأخرى جامعية تبين أن إدارة المستشفي التخصصي الشهير بمصر الجديدة، على علم بجرائم الاتجار، وسابق وجود تعامل بالبيع والشراء على الكلى المستأصلة والمزروعة، في حين أن باقي المستشفيات أجرت عمليات جراحية مع توافر حسن نية.

قرار الإحالة المعد من
النيابة بحق 5 متهمين، للمحاكمة الجنائية حمل، أسماء كل من ( ح.م.ا – 60 عام – طبيب بشري أستاذ جراحة كلى ورئيس مجلس إدارة مستشفى تخصصي شهير بمصر الجديدة، ون.ع.أ – 34 عام – سكرتيرة بمكتب زرع الكلى بذات المستشفى، وم.أ.م – 39 عام – عامل، وم.ع.ع – 44 عاما- عامل، وص.م.ع – 57 عاما- موظفة بذات المستشفى) وذلك لاتهامهم بقضية جديدة للاتجار في الأعضاء البشرية بقلب القاهرة.
وأسندت النيابة العامة للمتهمين بأنهم استهدفوا نقل وزراعة الأعضاء البشرية متعلمين في أشخاص طبيعيين وهم نحو 30 شخصا من المصريين وحملة الجنسيات الأجنبية حيث عرضوا سماسرة البشر علي المجني عليهم بيع أعضائهم البشرية نظير مبلغ مالي زهيد يقدر بـ “15 ألف جنيه” للكلية الواحدة.
ووجهت النيابة العامة للمتهمين أنهم استغلوا حالة الضعف والحاجة لدى المجني عليهم بقصد استئصال أعضاء من أجسامهم وزرعها في أجسام آخرين بغرض الحصول على منافع مادية والتربح من ورائهم بالمخالفة للقواعد والقوانين الطبية المنظمة لإجراء تلك العمليات وخارج المنشآت المرخصة لذلك.
وترتب على ممارساتهم الإجرامية إصابة عدد من المجني عليهم وتضرر حالتهم الصحية جراء استئصال أعضاءهم وهي “الكلى” عن طريق إجراء عمليات جراحية على يد أستاذ جراحة كلى مصري وكان يشغل منصب رئيس مجلس إدارة مستشفى تخصصي شهير بحي مصر الجديدة.
أقوال شهود الإثبات في القضية ضحايا مافيا الاتجار بالبشر
أدلى الشاهد الأول محمد س ي س 23 سنة بائع متجول بأنه قد تقابل مع الشاهد الثاني وإبلاغه الأخير بسداد المتهمين الثالث والرابع مبلغ 15 ألف جنيه له حال قبوله بيع كليته أو حال إرشاده عن ثم أخر على استعداد لذلك فابلغ السلطات عن تلك الواقعة.
وقال الشاهد الثاني رجب جلال محمد عبد العال 35 سنة سمكري سيارات، إنه أثناء تواجده بمنطقه الحسين تعرف على مجهول عرض عليه بيع كليته مقابل مبلغ 15 ألف جنيه مستغلا في ذلك ظروفه المادية الصعبة وحاجته إلى المال فوافق وقام الأخير باصطحابه إلى المتهم الثالث والذي اصطحبه إلى شقه بالمقطم وتقابل آنذاك مع أشخاص قاموا بالفعل ببيع كليتهم والبعض الأخر يتم تجهيزهم لذلك.
وأفاد بأنه أجرى الأشعة والتحاليل اللازمة لعمليه نقل كليته إلا أن المتهم المذكور أخبره بعدم صلاحيته لبيع كليته وعرض عليه العمل معه وإحضار أشخاص يرغبون في بيع كليتهم مقابل حصوله على مبلغ 1000 جنيه عن كل شخص.
إيصالات أمانة ومحاضر لضمان عدم تهرب الضحايا من بيع أعضائهم
وقال الشاهد الثالث رامي ع ف ٤٤ سنة تاجر أن المتهم الثالث والرابع أقنعاه ببيع كليته فقام أولهما بأخذ توقيعه على عدد ٦ إيصالات أمانة لضمان استمراره في إجراءات العملية ثم أقام بإحدى الوحدات السكنية “شقه” وأجرى الإشاعات والتحاليل والفحوصات اللازمة ورافقه ثانيهم أثناء قيامه بتحرير محضر بقسم شرطه قصر النيل والتوقيع على قرار لجنه زراعة الأعضاء بوزارة الصحة يفيد تبرعه بالكلى دون مقابل.
كما أضاف أنه عقب إجراء تلك العملية تقاضى من المتهم الثالث مبلغ 3000 جنيه ووعده بإعطائه باقي المبلغ وقدره 12.000 جنيه عقب قضائه فترة النقاهة إلا انه لم يتقاضاه نظرا لاكتشاف الأمر وضبطهم.
كما أضاف أنه أثناء تواجده بالشقة تلاحظ له وجود بعض الأشخاص الذين كانوا يريدون بيع كلاهم وكان يتم تجهيزهم لإجراء عمليات زرع واستئصال لهم وأثناء ذلك تناهى إلى سمعه اسم المتهمة الخامسة يتردد بين المتهمين سالفي الذكر بما مفاده اشتراكها في مزاوله نشاطهم الإجرامي.
وقال الشاهد الرابع م .ع ب 32 سنة عامل تلميع أحذية بميدان السيدة زينب بأنه أجرى العملية بمركز طبي بالإسكندرية بعد قيامه بالتوقيع على إقرار تبرع للمستشفى وعقب إجراء العملية تقاضى من المتهم الثالث مبلغ ٨٦٠٠ جنيه ووعده بإعطائه باقي المبلغ بعد عودته إلى القاهرة بعد استقطاع عمولته ولم يتقاضى المبلغ المتبقي حتى الإدلاء بأقواله.
فيما أدلت الشاهدة الخامسة مروة س س 22 سنة بدون عمل بأنها أثناء تواجدها بالمستشفى الشهيرة بمصر الجديدة لزيارة صديقين لها قاما ببيع كليتهما تقابلت مع شخص يدعى محمد م (سمسار في عمليات نقل الكلى) وعرض عليها بيع كليتها آنذاك مقابل مبلغ 15 ألف جنيه مستغلا في ذلك ظروفها المادية وحاجتها إلى المال.
فوافقت واصطحبها للمتهم الثالث والذي حصل على توقيعها على إيصال أمانه على بياض لضمان استمرارها في إجراءات العملية.
وأقامت معه بالشقة الكائنة بمنطقة فيصل والتي يجمع فيها الأشخاص الراغبين في بيع كليتهم إلا أنها ونظرا لطول الفترة التي أقامت فيها بالشقة وعدم قيامها بإجراء العملية تركت الشقة فاتصل بها المتهم عثمان م ر ع (توفى قبل ضبط المتهمين) وأقنعها حينئذ بإجراء العملية مقابل مبلغ نقدي. وأرسل معها شخص رافقها أثناء إجرائها الإشاعات والتحاليل والفحوصات اللازمة وحررت محضر بقسم شرطة قصر النيل ووقعت على إقرار لجنه نقل الأعضاء بوزارة ا
لصحة بمفاد تبرعها بالكلي دون مقابل.
وتوجهت إلى أحد المستشفيات الجامعية لإجراء العملية وعقب إجراء العملية تقاضت من المتهم المتوفى جزء من المبلغ النقدي محل اتفاقهما.
وأضافت أن المتهمين الرابع والخامس يعملان في مجال سمسرة بيع الكلى وأن المتهمة الخامسة كانت ترغب في تشغيلها تحت رئاستها في استقطاب المتبرعين.
استغلال حاجة الضحايا للمال وابتزازهم بإيصالات أمانة لبيع الكلى
وقال الشاهد السادس أشرف ح ا، 50 سنة، شيف بمطعم، بأنه توجه إلي المستشفي التخصصي ذاته لإجراء فحوصات له لشعوره بتضخم بالزائدة فتقابل مع المتهم الثانية مديرة مكتب زرع الكلى بالمستشفى واصطحبته لإجراء الكشوفات والتحاليل والإشاعات اللازمة.
وقامت المتهمة بعرضه على مالك المستشفي والذي أخبره بإصابته بحصوات في الكلى اليمني وأنها سوف تعدي الكلى اليسري وعرض عليه بيع تلك الكلية نظير مبلغ 15 ألف جنيه فقرر له آنذاك بأن ذلك المبلغ قليل فعرض عليه الأخير زيادة المبلغ إلى 20 ألف جنيه وطلب منه الاتفاق مع المتهم الثانية بشأن باقي تفاصيل العملية والتي أقنعته بإجرائها وعرفته على أربعه أشخاص كانوا متواجدين بالمستشفى وقتها وقررت له بأنهم سبق قيامهم بإجراء تلك العملية وإنهم الآن يعملون كسماسرة في تجارة الكلى وهم المتهمين الثالث والرابع وكذا شخص يدعى محمد م.
ونظرا لظروفه المادية وحاجته للمال وافق على العرض ووقع على إيصال أمانه على بياض لضمان عدم الرجوع عن الاستمرار في إجراءات العملية وتم إيوائه بشقه بمنطقة فيصل لتحضيره للعملية كما أجريت له الإشاعات والتحاليل والفحوصات اللازمة وأثناء ذلك قام بتحرير محضر قسم شرطه قصر النيل والتوقيع على إقرار لجنة زرع الأعضاء بواسطة وزارة الصحة بمفاد تبرعه بالكلى دون مقابل.
وأضاف أنه أجرى العملية بالمستشفى التخصصي بمعرفه الطبيب المتهم الأول بالقضية – زعيم التشكيل العصابي – وأنه كان على علم بوجود تعامل بالبيع والشراء على كليته.
وعقب إجراء العملية فوجئ بتهرب الأخير منه وعدم إعطائه المبلغ المتفق عليه فقام بتحرير محضر إداري الزيتون وأثناء ذلك تقابل مع موكلته المتهم الثانية بسرايا النيابة أثناء إدلائه بأقواله في المحضر المشار إليه وأعطته مبلغ 4000 جنيه ووعدته بباقي المبلغ عقب تنازله عن المحضر.

The first witness, Muhammad S.S.S., 23 years old, a traveling salesman, stated that he had met with the second witness, and the latter informed him of the payment of the third and fourth defendants, the sum of 15 thousand pounds, to him if he accepted the sale of his kidney or if he was instructed to do so. Then he informed the authorities about that incident.
The second witness, Rajab Jalal Muhammad Abd al-Aal, 35, a car plumber, said that while he was in the Al-Hussein area, he met an unknown person who offered to sell his kidney for an amount of 15,000 pounds, taking advantage of his difficult financial conditions and his need for money, so he agreed and the latter took him to the third accused, who took him to his apartment In Mokattam, he met with people who had already sold their kidneys and some were preparing for it.
He stated that he had performed the necessary x-rays and analyzes for his kidney transplant, but the aforementioned accused told him that he was not fit to sell his kidney and offered to work with him and bring people who wanted to sell their kidneys in return for a sum of 1,000 pounds for each person.
Trust receipts and records to ensure that victims do not evade selling their organs
The third witness, Rami A. F., 44, a merchant, said that the third and fourth accused persuaded him to sell his kidney, so the first of them took his signature on 6 trust receipts to ensure that he continued with the operation procedures. He also added that after performing that operation, he received from

He also added that while he was in the apartment, he noticed that there were some people who wanted to sell their kidneys, and they were being prepared for transplants and excisions, and during that time, he heard the name of the fifth accused repeating between the aforementioned defendants, implying her participation in their criminal activity.
The fourth witness, M.A., 32 years old, a shoe polisher in Sayeda Zeinab Square, said that he performed the operation in a medical center in Alexandria after he signed a donation declaration to the hospital. He receives the remaining amount until he makes his statement.
While the fifth witness, Marwa S.S., 22 years old, without work, said that while she was in the famous hospital in Heliopolis to visit two friends of hers who sold their kidneys, she met a person named Muhammad M (a broker in kidney transplants) and he offered to sell her kidney at that time for an amount of 15,000 pounds, using that Her financial conditions and her need for money.
She agreed and escorted her to the third defendant, who obtained her signature on a blank security receipt to ensure that she continued with the operation.
She resided with him in the apartment located in the Faisal area, in which people who wish to sell their kidneys gather, but due to the long period she resided in the apartment and the failure to perform the operation, she left the apartment, so the accused, Othman MR. A person who accompanied her while she was conducting the necessary rumors, analyzes and examinations sent with her a report at the Qasr al-Nil Police Department and signed the acknowledgment of the Organ Transfer Committee at the Ministry of Health stating that she had donated the kidney for free.
I went to a university hospital to perform the operation, and after the operation, I received a portion of the cash amount from the deceased accused from their agreement.
She added that the fourth and fifth defendants work in the field of brokerage selling kidneys, and that the fifth defendant wanted to operate it under her leadership in order to attract donors.
Exploiting the victims’ need for money and blackmailing them with trust receipts to sell kidneys
The sixth witness, Ashraf H., 50 years old, a chef in a restaurant, said that he went to the same specialized hospital for tests because he felt an enlarged appendix, so he met with the second accused, the director of the kidney transplant office in the hospital, and accompanied him to conduct the necessary examinations, analyzes and rumors.
The accused presented him to the owner of the hospital, who told him that he had stones in the right kidney and that it would infringe the left kidney. He offered to sell that kidney for an amount of 15 thousand pounds, and he decided at the time that that amount was small, so the latter offered him to increase the amount to 20 thousand pounds and asked him to agree with the second accused Regarding the rest of the details of the operation, which I convinced him to perform, and I introduced him to four people who were in the hospital at the time, and I decided to him that they had previously performed that operation and that they are now working as brokers in the kidney trade, and they are the third and fourth defendants, as well as a person named Muhammad M.
In view of his financial circumstances and his need for money, he agreed to the offer and signed his security receipt in blank to ensure that he did not return to the continuation of the operation procedures. Organs through the Ministry of Health to donate the kidneys for free.
